Terms and Conditions for Online Sales
PLEASE READ THE TERMS AND CONDITIONS CAREFULLY BEFORE PLACING AN ORDER FROM Blooms Art Club, AND RETAIN A COPY OF THEM AND YOUR ORDER FOR FUTURE REFERENCE.
BY CONTINUING WITH A PURCHASE IT IS DEEMED THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO THESE TERMS AND CONDITIONS.
Terms
The terms of sale set out here apply to goods supplied by Blooms msArt Club, ordered from the Blooms Art Club studio website at bloomsartclub.com. By continuing with a purchase it is deemed that you have read, understood and agree to these terms and conditions.
You must be 18 years of age or older to order from the website and by accepting these terms and conditions you are confirming this.
Blooms Art Club reserves the right to change these Terms and Conditions without notice to you in relation to future sales.
These terms do not create any rights to any parties other than the purchaser.
Orders and Prices
Blooms Art Club uses Square as their online purchasing systems.
Blooms Art Club accepts payment by any of the credit cards shown as acceptable on the website at time of purchase.
All prices are shown in US dollars and are subject to tax, VAT or/and delivery charges unless otherwise stated. These charges where applicable will be added on confirmation of your address and payment details and prior to the order being placed during the payment process.
All prices may be subject to change. Prices for specific works may rise as an edition begins to sell out.
The description and price of goods will be as shown on the website at the time you place your order. Every effort will be made to ensure that prices shown on the website are accurate at the time of purchase. If an error is discovered prior to dispatch of your order, Blooms Art Club will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or canceling your order.
When ordering online your order will be sent to Blooms Art Club through Stripe by email. You will also receive an email receipt to confirm Blooms Art Club has received your order. Should you not receive an email please contact the shop by email at orders@bloomsartclub.com.
All goods are subject to availability. If on receipt of your order the goods are out of stock, Blooms Art Club will inform you and refund or re-credit you for any sum that has been paid by you for the unavailable goods.
Blooms Art Club is under no obligation to accept any order.
Delivery
All delivery times quoted on the Blooms Art Club website are estimates based on availability, normal processing and delivery times. Blooms Art Club may deliver items from the same order separately but will charge for postage and packing as per the original order.
Goods ordered will be delivered to the address given when the order was placed, subject to receipt of an order confirmation email.
All work will be sent to you by USPS. Blooms Art Club will endeavor to deliver purchased art within 21 days (US) of receipt of payment unless otherwise stated on the website, or advised by email from the gallery at the time of purchase.
If there is no one available at the delivery address to accept delivery of goods, you will be notified of an alternative delivery date or place to collect the goods (US). Blooms Art Club cannot accept responsibility for goods that are returned to the post office and remain uncollected.
A signature will be required on delivery for special delivery purchases. You will be notified via email upon confirmation of order if your goods require special delivery. Receipt of a signature at the delivery address for special delivery orders will act as proof that the order has been delivered to you. For all other orders, USPS confirmation of order delivery will act as proof that the order has been delivered to you.
Once the art work is considered delivered, responsibility for the work, risk of damage or loss will pass to you and you shall be responsible for insuring the work.
If Blooms Art Club is unable to deliver your order within 45 days, the gallery will inform you as soon as possible and you will be entitled to cancel the order and obtain a full refund that will be paid to the credit or debit card with which you originally paid for your order.
Blooms Art Club is not liable for any loss or damage suffered by you through any unavoidable delay in delivery of an order. Blooms Art Club is not liable for any damage which occurs to an order after a delivery has been made.
Ownership and Copyright
Once an art work is in your possession you may not publish or submit for publication or reproduction any image of an art work to any third party including the internet for any purpose. Copyright belongs to Blooms Art Club. Images of sold paintings and prints may still be used by Blooms Art Club for any future use including but not limited to advertising, books and other publications, social media and other web based use.
Payment Security
Blooms Art Club uses Square for online payments. Square allow us to safely process your credit card payments and complete the financial transactions as securely as possible.
Blooms Art Club is not liable for any unauthorized access to information supplied by you.
Privacy
Blooms Art Club does not disclose buyer’s information to third parties. Please see our privacy statement for further details.
Returns
In cases of goods that are damaged or wrongly supplied please contact the shop at orders@bloomsartclub.com
Blooms Art Club accepts no responsibility for goods damaged or lost in transit. Please see returns policy for further information.
